Alternative Dispute Resolution (ADR) has a long history of use in labor, workplace and construction disputes. In fact, the construction industry is often seen as the lead innovator in the use of ADR techniques to address and resolve disputes in on-going projects while keeping the project moving forward. ADR is a broad subject. ADR is applied in all types of business and personal negotiations – from employment disputes to business mediations to neighborhood groups to international refugee crises. These situations may arise out of an impromptu confluence of circumstance or have a formal pathway for resolution defined by the contract. The programs will touch upon the core principles and practices of Alternative Dispute Resolution with a special emphasis on contractual sitituations.
The speakers will describe the different approaches to dispute resolution, namely;
• Negotiation • Mediation • Arbitration • Litigation and their variations along with the advantages and disadvantages of each. In addition, the speakers will cover the support (documentation, visual aids) that enhances the presentation of a dispute. The presentation will be illustrated by real life examples and the program will allow for questions from the audience. Speakers: Anthony J. Giuriceo, Esq. E. Giuriceo, Esq. Tony has spent the majority of his professional life as a lawyer in the engineering/construction and engineered products fields with such companies as Lummus, Research Cottrell, and lastly ABB as Vice President and General Counsel. Following his corporate career, Tony worked in several law firms and now is a sole practitioner in his own firm. He specializes in project management consulting; commercial contracts that support engineering, procurement, and construction activities; and serves as a mediator or arbitrator. He had worked as a process engineer and a sales engineer prior to becoming an attorney. Tony received his Bachelor of Science in Chemical Engineering degree from Manhattan College and his J.D. from Seton Hall School of Law. He is the immediate past chair of the Construction Law Section of the NJ State Bar Association and a past president of the NJ Chapter of the American Corporate Counsel Association. E. Mitchell Swann PE, LEED AP, MDC Systems, Inc. Drexel University Bachelor of Science, Mechanical Engineering A Licensed Professional Engineer in 12 States, and US Green Building Council LEED Accredited Professional (NC and CM Short Course) Over 25 years of extensive experience in design, construction, project management and forensic analysis of complex mechanical, control and building systems for both US and International projects. Mr. Swann project experience has spanned a wide range of industries and building types including pharmaceutical manufacturing, commercial, institutional and industrial facilities, hospitals, laboratories, microelectronics and data centers. Board of Directors - The Engineer’s Council of Philadelphia, and Pennsylvania Environmental Council, Drexel University - Alumni Board of Governors, The Enterprise Center CDC – Board Chair John Gossard, Director, Engineering, US SOD, Actavis, Inc. John is currently the Director, Engineering, US SOD, for Actavis Inc. He oversees the Project Management, Maintenance, Facilities and Automation groups for four US sites of the international generic pharmaceutical company. He has over twenty years of experience in the pharmaceutical industry. His previous role at Alpharma (purchased by Actavis, Dec. 2005) was as Manager, Equipment Qualification John began his career in the pharmaceutical industry at Glatt Air Techniques (pharmaceutical equipment OEM), where he assumed increasing responsibilities beginning with Applications Engineering through creation and management of the Validation Engineering dept. He is a member of ISPE for over fifteen years.
